Terms of Service

Welcome to Breathe. These Terms of Service ("Terms") are a legal agreement between you and Type-3 Studio ("we", "us", "our") governing your use of the Breathe application (the "Service"), including any web, Android, or iOS versions. Please read them carefully before using the Service.

Health and safety first. Breathe is a guided breathing and relaxation tool, not a medical device and not a substitute for professional medical advice, diagnosis, or treatment. Breathing exercises — especially breath-holding techniques — carry real risks.
  • Do not use the Service while driving, in or near water, at height, or while operating machinery, or in any situation where losing consciousness could cause harm.
  • If you have a heart condition, high or low blood pressure, epilepsy, a respiratory condition, or any other medical concern, or if you are pregnant, have recently had surgery, or are taking medication, consult a qualified healthcare professional before use.
  • Photosensitivity: the Service contains animated visuals with pulsing and glowing effects that may, in rare cases, trigger seizures in people with photosensitive epilepsy.
  • Stop immediately if you feel light-headed, dizzy, faint, short of breath, or unwell in any way.

1. Acceptance of these Terms

By installing, accessing, or using the Service — including by tapping "Accept" on the first-run notice — you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Service.

2. The Service

The Service provides guided breathwork sessions, animated visuals, optional ambient audio, and optional weather information. The Service runs primarily in your web browser and may be installed as a Progressive Web App for offline use. Certain features are optional and only operate when you enable them. We may add, change, or remove features at any time.

3. Not medical advice; no emergency service

The content and features of the Service are provided for general wellness and educational purposes only. They do not constitute medical advice, diagnosis, or treatment, and no doctor–patient or similar professional relationship is created by your use of the Service. The Service has not been evaluated or approved by any health authority (including, without limitation, any national health ministry or medicines regulator) as a medical device.

The Service is not an emergency, monitoring, or alerting service. It cannot and does not detect, diagnose, or respond to medical emergencies. In the event of a medical emergency, call your local emergency services immediately.

Always seek the advice of a qualified healthcare provider with any questions about a medical condition. Never disregard professional medical advice or delay seeking it because of something you have read or experienced in the Service.

4. Photosensitivity and seizures

A small percentage of people may experience seizures or blackouts when exposed to flashing or pulsing lights, patterns, or animated visuals. The Service uses animated graphics, including pulsing glow effects. If you or anyone in your family has a history of seizures or photosensitive epilepsy, consult a doctor before using the Service. Stop use immediately and consult a doctor if you experience any symptoms such as light-headedness, altered vision, eye or face twitching, jerking of arms or legs, disorientation, confusion, or momentary loss of awareness.

5. Assumption of risk

You use the Service voluntarily and at your own risk. You acknowledge that breathing exercises, including deep breathing and breath retention, can cause light-headedness, dizziness, tingling, fainting, or, in rare cases, more serious harm, and that individual responses vary. You accept full responsibility for your own health, wellbeing, and safety during and after every session, for choosing an appropriate environment in which to practise, and for deciding that you are medically fit to use the Service.

6. Eligibility

You must be at least 18 years old to use the Service, or, if you are between 13 and 18, use it only under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf. The Service is not directed to children under 13, and we do not knowingly collect personal information from them.

8. Intellectual property

The Service, including its software, design, artwork, characters, text, sounds, and branding, is owned by or licensed to Type-3 Studio and is protected by intellectual- property laws (including copyright, trademark, and related rights). You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes. All rights not expressly granted are reserved. Third-party assets (including fonts and audio) remain subject to their own licences.

If you provide us with feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use them for any purpose without obligation or compensation to you.

9. Third-party services

The Service may use third-party services, such as weather data from Open-Meteo, reverse-geocoding from OpenStreetMap Nominatim, and your browser's geolocation capability, when you choose to enable the weather feature. Your use of those services may be subject to their own terms and privacy policies, and we are not responsible for them. See our Privacy Policy for details.

10. Availability, changes, and force majeure

We may add, change, suspend, or discontinue any part of the Service at any time, including features that rely on third-party services. We do not guarantee that the Service will be uninterrupted, error-free, secure, or available on every device or in every location.

We will not be liable for any failure or delay in performing our obligations to the extent caused by events beyond our reasonable control, including but not limited to network or power failures, third-party service outages, acts of government or authorities, natural disasters, or other force majeure events.

11. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements or produce any particular health or wellness outcome.

12. Limitation of liability

To the fullest extent permitted by law, Type-3 Studio and its owners, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of, or inability to use, the Service. This includes, without limitation, any injury or harm arising from breathing exercises undertaken using the Service. Where liability cannot be excluded, our total aggregate liability shall not exceed the greater of the amount you paid us (if any) in the twelve months before the claim, or USD 50. Nothing in these Terms limits liability that cannot be limited or excluded under applicable mandatory law.

13. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Type-3 Studio and its owners, employees, agents, and contractors from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any law or third-party right.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and the version number above, and the Service will ask you to accept the updated Terms before you continue. Your continued use after acceptance constitutes agreement to the revised Terms.

15. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.

16. Dispute resolution and class action waiver

Before bringing any formal claim, you agree to contact us first and attempt to resolve the dispute informally for at least 30 days. To the fullest extent permitted by law, you and Type-3 Studio agree that each may bring claims only on an individual basis, and not as a plaintiff or class member in any class, collective, or representative action, and each party waives any right to a trial by jury in connection with these Terms.

17. Governing law and jurisdiction

These Terms are governed by the laws applicable at Type-3 Studio's principal place of business, without regard to conflict-of-law principles, and without limiting any mandatory consumer protections available to you in your country of residence. Courts in that jurisdiction shall have non-exclusive jurisdiction, except where mandatory local law (including mandatory rules in your country of residence) provides otherwise. This clause does not deprive you of any mandatory rights you hold under the law of the country in which you are domiciled.

18. General provisions

Severability. If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions remain in full force. Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Service. No waiver. Our failure to enforce any provision is not a waiver of our right to do so later. Assignment. You may not assign or transfer these Terms or your rights under them; we may assign them without restriction, including in connection with a merger, acquisition, or sale of assets.
